Proclamation
[Article] 28. Penalties
Unless severe penalties are prescribed in the
criminal law:-
1/ any person who without permission from the
Authority transfers, alters, disposes or disperses
nuclear materials that are likely to cause death or serious injury to any
person or substantial damage to property shall be punishable with an
imprisonment from 3 to 15 years or with a fine from Birr 50,000 to Birr 500,000
or with both;
2/ any person who without permission from the
Authority possesses nuclear materials shall be punishable with an imprisonment
from 1 to3 years or with a fine from Birr 10,000 to Birr 50,000 or with both;
3/ any person who without permission from the
Authority uses nuclear materials and cause damage
shall be punishable with a rigorous imprisonment from 10 to 15 years or with a
fine from Birr 100,000 to Birr 500,000 or with both;
4/ any authorized person to use nuclear material
who causes damage due to negligence shall be punishable with a rigorous
imprisonment from 3 to 10 years or with a fine from Birr 50,000 to Birr 100,000
or with both;
5/ any person Who commits other offences in
violation of the provisions of Proclamation or regulations or directives issued
pursuant to this Proclamation, shall be punishable with an imprisonment not
exceeding 3 years or with a fine not exceeding Birr 10,000 or with both.
