AS, it has become necessary to amend the Definition of Powers and Duties of the
Executive Organs of the Federal Democratic Republic of Ethiopia Proclamation
NOW, THEREFORE, in accordance with Article 55 (1) of the Constitution of the Federal Democratic Republic of Ethiopia, it is hereby proclaimed as follows:
This Proclamation may be cited as the “Definition of Powers and Duties of the Executive Organs of the Federal Democratic Republic of Ethiopia (Amendment) Proclamation No. 603/2008”.
Definition of Powers and Duties of the Executive Organs of the Federal
Democratic Republic of Ethiopia Proclamation No. 471/2005 (as amended) is
hereby further amended as follows:
1/ sub-article (8) of Article 9 of the Proclamation is repealed and amended by the following new sub-article (8):
“8/ the Ministry of Science and Technology;”
2/ sub-article (11) of Article 15 is repealed and sub-articles (12), (13) and (14) are renumbered as sub-articles (11), (12) and (13).
3/ Article 20 of the Proclamation is repealed and amended by the following new Article 20:
“20. Ministry of Science and Technology
The Ministry of Science and Technology shall have the powers and duties to:
1/ forward recommendations based on studies for adopting and revising policies, strategies, laws and directives on the development of science, technology and innovation activities that support the realization of the country’s socio-economic development objectives;
2/ prepare science, technology and innovation master plans; provide guidelines for the preparation of sector annual plans, programmes and projects; review and submit them to the Government for approval; monitor and evaluate their implementations;
3/ set priorities for the country’s research activities, and ensure that the conforrm to the country’s development strategies;
4/ direct, coordinate and support science, technology and innovation activities and country-wide research programmes with a view to realizing the country’s social and economic development objectives;
5/ facilitate conditions to ensure strong inter linkage among higher education, research and development and the industrial sector with regard to scientific research and technological advancement focusing on production activities;
6/ create public awareness and ensure the applicability of scientific and technological achievements that are useful for the country;
7/ develop the capability for searching, selecting, negotiating, procuring and importing technologies that are appropriate for the country’s socio-economic condition and establish a system for the import, utilization and disposal of technologies;
8/ support the efforts to develop and upgrade the competent man power required for science, technology and innovation activities; and build national capability thereof;
9/ collect and organize information on science, technology and innovation; formulate and disseminate applicable indicators on science and technology; set and follow up the implementation of standards for the assurance of the quality, safety and reliability of information;
10/ encourage studies and research and development activities carried out to improve and develop indigenous technologies, and ensure their application and support efforts thereof;
11/ support and strengthen institutions that undertake research and development activities and have contribution in the development of science and technology; propose, as may be necessary, the establishment of new institutions rendering scientific and technological services;
12/ provide professional and technical support to regional science and technology institutions with a view to building their capabilities;
13/ establish and implement a system for granting awards and incentives to individuals and institutions that have contributed to the development of science, technology and innovation;
14/ assist and encourage the establishment of associations that contribute to the development of science, technology and innovation and provide support for the publication and dissemination of science and technology papers prepared by professional associations;
15/ encourage the practical application of inventions that support technology transfer; establish and implement of a patent system that encourages and advances such inventions;
16/ follow up the implementation of monitoring system for the use and disposal of rays’ and sources of rays’ equipment.
17/ ensure the proper provision of quality and standardization services;
18/ support the provision of technical, consultancy and capacity building services to users of scientific instruments to enable them discharge their activities effectively;
19/ establish science and technology councils and science academy that support the implementation of science, technology and innovation system.
20/ establish relations, in various fields of cooperation, with foreign and international institutions having similar objectives.”
4/ paragraph (a) of sub-article (3) of Article 33 of the proclamation is repealed and paragraphs (b), (c) and (d) are renumbered as paragraphs (a), (b) and (c), respectively.
5/ the following new sub-article (19) is added following sub-article (18) of Article 33 of the Proclamation:
“19/ The following executive organs shall be accountable to the Ministry of Science and Technology:
1/ the Ethiopian Radiation Protection Authority;
2/ the Quality and Standards Authority of Ethiopia;
3/ the Ethiopian Centre of Scientific Instrumentation;
4/ the Ethiopian Intellectual Property Office.”
6/ the following new paragraph (f) is added under sub-article (1) of Article 34 o the Proclamation:
“f) the Ethiopian Science and Technology Commission Establishment Proclamation No. 7/1995.”
7/ the following new sub-article (8) is added under Article 35 of the Proclamation;
“8) The rights and obligation of the Ethiopian Science and Technology Agency is hereby transferred to the Ministry of Science and Technology.”
8/ the following new Article 34 is added under Part Four of the Proclamation:
“34. Reorganization of Federal Executive Organs
The Council of Ministers is hereby empowered, where it finds it necessary, to reorganize the federal executive organs by issuing regulations for the closure, merger or division of an existing executive organ or for change of its accountability or for the establishment of a new one,”
9/ Article 34, 35 and 36 of the Proclamation are renumbered as Article 35, 36 and 37, respectively.
Proclamation shall enter into force up on the date of publication in the
Federal Negarit Gazeta.
